Terms of Service

1. General Terms

These Terms of Service govern the legal relationship between FastNotaryUp and our clients for all notary public and document authentication services. By using our services, you agree to these terms and conditions.

Scope: These terms apply to all services provided by FastNotaryUp, including document notarization, apostille services, mobile notary services, and related legal authentication services. Any deviations from these terms must be agreed upon in writing.

2. Service Scope

FastNotaryUp provides comprehensive notary public services for individuals and businesses of all sizes. Our service range includes:

• Document Notarization: Authentication of signatures, administration of oaths, and certification of document copies
• Real Estate Services: Notarization of property deeds, mortgage documents, and real estate transaction papers
• Corporate Services: Business agreement authentication, corporate resolutions, and commercial document certification
• Mobile Notary Services: On-site document authentication at your location
• Apostille Services: International document authentication and certification
• Legal Document Support: Power of attorney, wills, and statutory declaration services

The specific scope of services will be determined in individual service agreements. Additional services will be arranged and billed separately.

3. Client Obligations

For proper delivery of our services, our clients are required to:

• Complete Documentation: Provide all relevant documents and information in digital or physical form
• Timely Submission: Submit documents by agreed-upon deadlines
• Accurate Information: All information must be correct and complete
• Cooperation: Active participation in questions and clarifications
• Timely Payment: Settlement of invoices within agreed payment terms
• Valid Identification: Provide government-issued photo identification for all notarizations

Late or incomplete provision of documents may result in additional costs that will be charged to the client.

4. Fees and Payment Terms

Compensation is based on service type and complexity according to individual service agreements.

• Standard Rates: $25 per document for basic notarizations
• Package Services: Real estate packages starting at $150, corporate services at $300
• Payment Terms: Payment due within 30 days of service completion
• Late Fees: 2% per month on overdue balances
• Additional Costs: Travel fees, rush services, and specialized procedures billed separately

5. Liability and Warranty

FastNotaryUp provides all services with the utmost care and according to recognized principles of Canadian notarial practice.

Liability Limitation: Liability is limited to gross negligence and willful misconduct. The amount of liability is limited to three times the annual service fees, but not exceeding CAD $50,000.

Warranty: Defective services will be corrected at no charge if they are due to FastNotaryUp's fault. Further claims are excluded.

6. Confidentiality and Data Protection

FastNotaryUp commits to strict confidentiality of all client information:

• Professional Secrecy: All employees are bound to confidentiality
• Data Protection: Personal data handled according to Canadian privacy laws
• Data Security: Technical and organizational measures to protect data
• Record Retention: Records maintained according to legal requirements (minimum 10 years)

7. Termination and Contract Ending

Service relationships may be terminated by either party with proper notice:

• Notice Period: 30 days written notice for ongoing service contracts
• Immediate Termination: Possible for important cause
• Document Return: After full payment of all invoices
• Record Retention: Documents retained for 10 years, then destroyed

8. Final Provisions

Applicable Law: These terms are governed by the laws of Ontario, Canada.

Jurisdiction: Exclusive jurisdiction is Toronto, Ontario, Canada.

Amendments: Changes to these terms require written form. If individual provisions become invalid, the remainder of the contract remains valid.

Effective Date: These terms take effect on January 1, 2025, and replace all previous versions.

9. Refund Policy

At FastNotaryUp, we are committed to providing exceptional notary public services for individuals and businesses. We understand that circumstances can change, and have established the following refund policy to ensure fairness and transparency:

If you need to cancel your scheduled notary appointment or service, the following conditions apply:

• Cancellation with 24+ hours notice: Full refund minus a 10% processing fee
• Cancellation with 12-23 hours notice: 75% refund of service fees
• Cancellation with 4-11 hours notice: 50% refund of service fees
• Cancellation with less than 4 hours notice: 25% refund of service fees
• No-show or cancellations after service completion: No refund will be granted

For ongoing service contracts and retainer agreements:

• Monthly service packages may be cancelled with 30 days written notice, but we do not prorate refunds for the current billing period
• Quarterly and annual service agreements may be terminated with 30 days notice and prorated refunds, minus a 15% administrative fee
• Individual notary appointments require 24 hours notice for cancellation or rescheduling without penalty

Special considerations for our clients:

• For unexpected serious illness, family emergency, or force majeure circumstances (with documentation), we offer the option to reschedule or transfer to a future service
• We offer the option to transfer your appointment to another qualified person at no additional cost
• If you are unsatisfied with our notary service, please contact us within 7 days of completion to discuss possible remedies or alternative solutions

To request a refund, please contact our client service team by phone or email. All approved refunds will be processed within 10 business days using the original payment method. For ongoing contracts, please refer to the specific conditions in your service agreement.
